Competitor Drops Challenge to Kering Eyewear’s ‘Made in Italy’ Labeling

The lawsuit was resolved out of court.

Eyewear company Selima Optique has dropped a lawsuit it filed against France-based Kering, The Fashion Law reports.

Selima had claimed in federal court that the “Made in Italy” labeling Kering brand places on its luxury eyewear was not accurate.

Now Kering tells The Fashion Law in a statement: “Selima Optique voluntarily dismissed a complaint it filed against Kering Eyewear and Kering with prejudice and without any payment from Kering Eyewear or Kering.”

Selima had claimed in its suit that Kering falsely represents its eyewear as being made in Italy when “in truth, their products, or substantially all parts of their products, are made in China, and (at best) shipped to Italy for final assembly and packaging, and then exported.”

Kering strongly denied Selima’s claims.

Selima sells Kering brands along with its own products. Kering’s portfolio includes names such as Gucci, Balenciaga and Yves Saint Laurent.

Selima had claimed in its filing that it received YSL frames from Kering that were stamped with both “Made in Italy” and “Made in China.” A Kering spokesperson told INVISION in June that a mislabeling had occurred because of a mixup at a facility in Italy. The “Made in China” stamp was intended only for certain Puma sunwear that is indeed produced in China, the spokesperson said.
