(PRESS RELEASE) Eco Eyewear has achieved a significant victory in preventing Eyespace Eyewear Ltd from trademarking ‘Eco Conscious Optics’. The Opposition Division of the European IP Office has upheld Eco Eyewear’s objections, rejecting the trademark application due to its close similarity to the prior trademark “ECO EARTH CONSCIOUS OPTICS”.
The comparison revealed that they share common verbal elements, ‘ECO’ and ‘CONSCIOUS’, leading to a conceptual association with the ‘ECO’ concept. Consequently, the Opposition Division concluded that there is a likelihood of consumer confusion, as the average consumer might assume that the goods bearing the above marks come from the same or economically linked undertakings.
