Effort to Allow Eyecare at Wal-Mart, Other Stores Clears a Key Hurdle

A petition to allow eyecare services to be provided inside Wal-Mart and other big-box stores is not unconstitutional, the state’s Supreme Court has ruled.

The Oklahoma Association of Optometric Physicians had claimed that the petition ran counter to the state’s constitution, The Associated Press reports. The group said the petition covered several topics and thus was an example of “log-rolling”; Oklahoma law says legislation must concentrate on a single subject.

The ruling means proponents of the change can continue with their efforts.

Oklahomans for Consumer Freedom, which has the support of Wal-Mart, is behind the petition. The group’s Gwendolyn Caldwell told NewsOK last year that the goal was to give consumers “more choices, better prices, convenience.”

But Joel Robinson, head of the Oklahoma Association of Optometric Physicians, has said the proposal is not a good idea, and could make things tough for ECPs in small communities.
