Opternative Files Suit Against Warby Parker

The litigation centers on online eye exams.

Opternative has filed a lawsuit against Warby Parker alleging that the eyewear retailer violated non-disclosure agreements and took its trade secrets.

The litigation focuses on Warby Parker’s Prescription Check service, Tech Crunch reported. Opternative claims that the exam derives from Opternative technology.

Dr. Steven Lee, co-founder of Opternative, told Tech Crunch: “It is a huge disappointment that another company, which was in the startup category like us not too long ago, would take advantage of us for their own financial gain.”

But Warby Parker told the news outlet in a statement that the allegations “do not accurately reflect reality.” It said Opternative is “choosing to address competition with litigation instead of innovation.”

The companies had considered a partnership, and Warby Parker tested the Opternative technology, according to the lawsuit. But Warby Parker then decided to move forward with its own patented online eye exam.

Among Opternative’s allegations is breach of contract.
