Court Ruling Makes Professional Licensing Boards Vulnerable

“Boards run by people who practice the profession have become the norm.”

The Supreme Court has affirmed an FTC policy exempting state licensing boards from anti-trust law suits only if they are supervised by state government. The specific case before the court involved a North Carolina dental board “controlled by active market participants.” A piece by two law professors in the Wall Street Journal predicts “A number of suits against boards will likely follow,” adding, “That is a good thing. Last year … the University of Pennsylvania Law Review … detailed the excesses of professional licensing. Boards run by people who practice the profession have become the norm.”
