Another Lawsuit Seeks to End Contact-Lens Price Policy

More than a dozen states are considering a ban.

Add New Jersey to the list of states where class-action lawsuits seek to put an end to mandatory minimum-price requirements by manufacturers of contact lenses. More than a dozen states are now considering legislation aimed at stopping the policy, which opponents like discounters 1-800 Contacts and Costco contend is a violation of antitrust laws. Supporters of the law say that setting a minimum price better protects consumers, especially those who purchase their contact lenses from eye doctors. In a prepared statement, the Oregon Optometric Physicians Association explained that the bill to outlaw minimum-price requirements would “[de-emphasize] and [devalue] the critical and federally required role of eye health providers in the prescription and monitoring of contact lenses.”
