Online Contact Lens Seller to Pay $36K in Settlement with Attorney General

The AG said the firm wasn’t requiring prescriptions.

Online contact lens seller THEG Inc., which does business as Fine & Clear, has agreed to pay $36,000 in a settlement with Texas Attorney General Ken Paxton.

The state’s Consumer Protection Division found evidence that the company was “selling contact lenses to consumers without requiring consumers to present a valid prescription upon purchases,” according to the settlement filed in District Court in Bexar County, TX.

The company and its president, Hyunyil Cho, have voluntarily stopped selling contact lenses and agreed “that they will continue to cease selling lenses to consumers unless each consumer provides upon purchase a valid prescription.”

The settlement “does not constitute an admission of wrongdoing or an admission of a violation of any applicable legal provisions,” according to the filing.

The settlement figure includes $31,000 in civil penalties to be paid to the state of Texas and $5,000 for attorneys’ fees and investigative costs.

The company and its president also agreed to provide refunds to consumers who bought contact lenses from them, provided the products are returned in an unopened box within 90 days of the settlement.

They also agreed to cooperate fully with the Consumer Protection Division “in investigating and prosecuting individuals and/or entities which distribute, sell, provide, or otherwise unlawfully introduce into commerce contact lenses.”
