Class-Action Complaint Filed Against Large Eyewear Retailer Alleging Bogus BOGO Offer

 

Plaintiff claims that the retailer jacks up the price of the first pair of eyeglasses that doesn’t make the second pair “truly free.”

A class-action complaint has been filed against Visionworks of America, one of the largest eyewear retailers in the country, over its buy-one, get-one-free offer on eyeglasses, Cook County Record reports.

The article says that Chicago resident Cheryl Lenart filed the complaint, claiming that San Antonio-based Visionworks “increases the ordinary and usual price for a single pair of eyeglasses, such that the second pair is not truly free.” In the complaint, she describes the online and print advertising that led her into a store in which “a salesclerk quoted her a price of $332.03 for a single pair of eyeglasses, and stated that the second pair of eyeglasses would be ‘free’ under the offer.” However, Lenart claims that “the ordinary and usual price for such a single pair of eyeglasses was approximately 40 percent less than the” $332.03 she paid.

If class certification is granted, the article adds, the class would include “tens of thousands” of people who accepted a BOGO offer from Visionworks in Illinois during the last three years. Lenart is seeking punitive damages of $5 million plus attorney fees.
