A Florida optometrist has won an age-discrimination lawsuit against his employer.

A jury determined that Dr. Timothy G. Moore’s employer, Capital Health Plan, should pay him $40,000, the Tallahassee Democrat reports. The award is for lost wages and benefits. 

At the same time, jurors “opted not to award punitive damages or money for emotional pain and suffering,” according to the newspaper. The jury did not feel that the health plan’s actions involved reckless indifference or malice.

Capital Health Plan maintained that it did nothing wrong.

Moore, who is now 66, claimed that he was discriminated against in 2013 when he applied for, but did not receive, a promotion.
