Snapchat Maker Sues for ‘Spectacles’ Trademark

Snap, the company behind Snapchat, is suing the U.S. government in an attempt to trademark the name “Spectacles” for its digital eyewear camera.

The U.S. Patent and Trademark Office previously rejected the trademark claim, the Verge reports. Snap is now suing the agency in U.S. District Court in California.

The USPTO previously found that “Spectacles” is a term that “has not acquired distinctiveness” and so does not merit a trademark.

Among its claims, Snap stated in a court filing that the term is distinctive in that it “evokes an incongruity between an 18th century term for corrective eyewear and Snap’s high-tech 21st century smart glasses.”

Snap rolled out the Spectacles product in 2016, but it largely fell flat with consumers. The company last year demonstrated an augmented reality iteration of the product, but that version has not yet been rolled out for the public.
